Commission Expands MSHA’s Jurisdiction

At a recent meeting, MSHA affirmed a judge’s decision that a mining equipment maintenance and fabrication shop that is operated off site by a mining company falls within the definition of a mine and is subject to all MSHA rules and regulations.

While this decision may appear to expand MHSA’s jurisdiction and require you to revise your current policies and procedures for off site shops, the Michigan MSHA office has been following this definition for a number of years.

Therefore, this serves as a reminder that if you have an equipment or fabrication shop (or portion of any off set shop that is dedicated to mining equipment) the same MSHA rules and regulations apply to the off site location just as if the shop was located within the mine.
